TERMS OF SERVICE

Auction Account and Bidder Verification

Browsing is open to everyone. Bidding and buying are not: both require an account and a verified identity. When you register you agree to:

• Give accurate, current and complete information, and keep it up to date
• Provide a clear photograph of a government-issued photo ID, front and back, for verification
• Hold one account only — a second account used to bid on the same lot is a breach of these Terms
• Keep your password confidential and accept responsibility for everything done under your account, bids included
• Be at least 18 years old and legally able to enter into a binding contract

We review identification by hand. We may approve, refuse, pause or withdraw bidding rights on any account at our discretion, and we may require further proof of identity or of funds before releasing a machine.

Bids Are Binding

Every bid you place is an irrevocable offer to buy that machine at that amount. Bids cannot be retracted once placed. If you are the highest bidder when a lot closes, a contract of sale is formed between you and us at your bid, and you are obliged to complete the purchase. Placing a bid without the intention or the means to pay is a breach of these Terms.

Bid Increments, Current Bid and Buy Now Full Price

The figure shown as Current Bid is the standing bid on that lot. The minimum step above it is $100 unless the lot states otherwise, and we may set a different increment on an individual lot. Some lots also carry a Buy Now Full Price: taking it ends the auction on that lot immediately and forms the contract at that figure, and it stays available only until the lot closes or another buyer takes it first.

There is no buyer’s premium, bidder fee or administration fee. What you bid, or the Buy Now Full Price you accept, is the price of the machine. Delivery, taxes and registration where applicable are separate and are quoted separately.

Bidder Privacy

We do not publish the identity of bidders. A lot shows the current bid and the time remaining and nothing about the people behind either. We will disclose bidder information only where the law requires it.

Closing, Withdrawal, Reserves and Errors

Each lot shows its closing time. Up to the moment a lot closes we may:

• Extend, re-open or reschedule a lot, including where a technical fault affected bidding
• Withdraw a machine from the auction, or correct its description, photographs or figures
• Decline to sell where a lot carries a reserve that has not been met
• Cancel a bid that we believe was placed in breach of these Terms

Obvious errors in a price, specification or description do not bind us, and we may cancel a sale that resulted from one and refund anything already paid. A lot that closes without meeting its reserve may be relisted.

Prohibited Bidding Conduct

The following are breaches of these Terms and may result in a cancelled bid, a voided sale, a suspended account and liability for our losses:

• Shill bidding — bidding on a lot to raise its price with no intention of buying. We do not bid on our own lots and we do not permit anyone to do so on our behalf
• Bidding through more than one account, or arranging with others to manipulate a lot
• Agreeing with other bidders not to bid against each other
• Using automated tools, scripts or scrapers to bid, monitor or copy the auction
• Interfering with the operation of the site, or attempting to reach parts of it you are not authorised to use

Payment

When a lot closes in your favour, or when you take a Buy Now Full Price, we issue your documents by email for electronic signature and raise your invoice. Payment is by bank wire transfer in US dollars. Banking details are released after the documents are signed, and the full amount is due within five (5) business days of the invoice date unless we agree otherwise in writing.

We release a machine for delivery once funds have cleared in our account. We do not accept cash.

If a Winning Bidder Does Not Pay

If payment is not received within the period above, we may cancel the sale, offer the machine to the next highest bidder, relist it or sell it privately, suspend or close the account, and recover from the defaulting buyer any shortfall against your bid together with the costs we incur. Nothing in this clause limits any other remedy available to us.

Ownership, Delivery and Storage

Ownership and risk of loss pass to you when funds have cleared and the signed Bill of Sale is delivered. This equipment is off-road machinery and is not titled by the DMV; the Bill of Sale, with the notarized acknowledgment where provided, is the record of ownership. All machines are shipped; we do not release equipment for collection from our yard. Where a machine cannot be released for delivery within fourteen (14) days of funds clearing for reasons attributable to you, a storage charge may apply, at a rate we will put in writing to you before it starts.

Condition, Inspection and the 30-Day Money-Back Guarantee

Every lot is inspected, photographed and documented before it opens, and that inspection report is published on the lot. You are also welcome to inspect a machine yourself, or to send your own inspector, by appointment before you bid.

We guarantee that a machine conforms to its written description and to its inspection report. If a machine is materially not as described, or carries a defect that we failed to find and disclose in that report, tell us within thirty (30) calendar days of delivery and return it in the condition in which you received it, and we will refund the purchase price in full. The guarantee does not cover a change of mind, wear consistent with the hours stated on the listing, consumable items, or damage, modification or neglect after delivery. Beyond this guarantee the machine is sold with all faults and no other warranty, express or implied, is given.

Delivery

We deliver door to door across the lower 48 states, insured in transit, and we can arrange permits and escorts for oversize loads as part of the freight quote. Figures produced by the shipping calculator are estimates for planning; the figure on your quote is the one we honour. You are equally welcome to collect with your own transport. Delivery dates are estimates and are not guaranteed.
